Privacy Policy of Color Match NEONAIL Mobile Application

§ 1. General Provisions

This Privacy Policy (hereinafter referred to as the “Privacy Policy”) describes how Cosmo Group Sp. z o.o. Sp.k. collects, processes and stores personal data necessary to perform the services provided through the Color Match NEONAIL mobile application (hereinafter referred to as the “App”).
The User acknowledges that the Controller of all data, including personal data processed through the App, is Cosmo Group Sp. z o.o. Sp.k. with registered office in Poznań, ul. Jasielska 10A, 60-476 Poznań, VAT ID 9721241158, entered in the Register of Companies kept by the District Court Poznań - Nowe Miasto & Wilda in Poznań, VIII Commercial Division of the National Court Register under KRS 0000437232 (hereinafter referred to as “Controller”).
The User is any natural person who uses the services provided through the App.
The User acknowledges that the provision of any data by the User, including personal data, is voluntary. The provision of any data, including personal data, by the User to the Controller shall take place upon acceptance of the Privacy Policy during the installation of the App on the end device.
Personal data provided by the User may be used by the Controller to generate statistics and summary reports for internal use, on the basis of which the Controller will be able to check Users’ navigation in the App. These statistics and summary reports will not contain any information that could personally identify the User.
While using the App, the User will be able to virtually try a selected colour of nail polish offered by the Controller on their hand. For this purpose, the App will use the camera and the camera application installed on the User's mobile device.
In order to use the functions of the App, the User is not required to provide any personal data, or to create a user account.
By installing the App on their device and using it, the User accepts the terms of this Privacy Policy.

§ 2. Automatically collected data

The Controller does not collect any personal data of the User by means of the App, only data of a different nature, in particular data of the mobile device used by the User and data on the use of the App. The collection of the data described in the previous sentence takes place automatically (hereinafter referred to as “automatically collected data”).
Automatically collected data does not allow for clear identification of the User.
Automatically collected data may be used by the Controller to improve the quality of the services provided, in particular in the event of an error in the App. In the situation described above, data collected automatically will relate to an error in the App, including the state of the User's mobile device at the time the error occurred and identification of the User's mobile device.
Automatically collected data is collected using cookies. Cookies are used in most mobile applications available in Poland. Cookies are text files with a unique identification number that are transferred from the App to the hard drive of the mobile device used by the User. Cookies only serve to identify the User’s mobile device, but do not store any personal information about the User, such as their name or address. The User is able to change the settings on their mobile device so that their mobile device will accept or reject cookies, or simply notify the User each time a cookie is configured by the App. Currently, we use cookies in the App to measure traffic statistics in our App and for the possibility to select specific products and add them to the shopping basket in the shop: www.neonail.pl.
The cookies mechanism used is safe for the User's mobile device, in particular it does not enable viruses or other unwanted software or malware to enter the User's mobile device.
Users can restrict or disable access to cookies on their mobile device by changing the settings on their mobile device. However, in such a case, the functionality of the App may be restricted.

§ 3. Data collected to enable selected products to be added to the shopping basket in the shop: www.neonail.pl

By means of the App, the Controller enables Users to add selected products to their shopping basket. If this function is used, by means of cookies installed in the App, the App will remember the product selected by the User and transfer the selection directly to the Controller's online shop, available at www.neonail.pl to enable the purchase transaction.
The processing of all data by means of the online shop www.neonail.pl takes place on the terms set out in the Privacy Policy for the online shop www.neonail.pl, made available at the following location: https://www.neonail.pl/polityka-prywatnosci.html.

§ 4. Rights and obligations of the Controller

The Controller undertakes to process all Users' data in compliance with security requirements, in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), also known as GDPR, and the Act of 18 July 2002 on the provision of electronic services.
The Controller shall ensure that appropriate technical and organisational measures are in place to ensure the security of the processed data, in particular to prevent access to the data by unauthorised third parties or their processing in violation of the generally applicable law, to prevent loss, damage or destruction of collected data.
The User's personal data will be stored for as long as necessary for the Controller to perform the services provided through the App.
The Controller shall be entitled to disclose the collected data concerning the User to: its subsidiaries; other third parties that have accepted the Privacy Policy, within the scope in which the Controller has concluded an agreement with them that is necessary for the performance by the Controller of the services provided by means of the App; competent authorities that report the need to access the personal data on the basis of relevant provisions of generally applicable law.
